Terms and conditions of sale

Hereinafter “the seller”.
2. Scope
These terms apply to sales made on henridejeant.com between the seller and a consumer buyer, hereinafter “the customer”. The customer accepts them when confirming the order; the applicable version is the one online on that day.
Trade customers (shops, architects, interior designers, hotels) are served on quotation, under their own terms.
3. The pieces
The pieces are made by hand in Béziers, in MoldingPulp, a material made of recycled paper, plaster and plant-based glue. Their specifications (dimensions, socket, bulb wattage, use) are given on each product page.
Because each piece is shaped by hand, slight differences in colour and texture, and a variation in size of 2 to 5 mm depending on the model, are part of its nature. The photographs show the pieces as faithfully as possible.
The lamps are designed for indoor use in dry rooms (IP21), with LED bulbs only: 10 W maximum, 20 W for the Amba.
4. Prices
Prices are shown in euros, including VAT, excluding delivery. Delivery costs are shown before the order is confirmed. The applicable price is the one displayed at the time of ordering.
5. Ordering
The customer chooses the pieces, enters the addresses, chooses a delivery and payment method, then checks the summary before confirming the order with a button stating the obligation to pay. A confirmation email is sent.
A colour on request, a one-off or a bespoke piece is subject to a prior quotation stating its price, lead time and conditions.
The seller may refuse an order if there is an earlier payment dispute with the customer.
6. Payment
The order is paid in full when placed: by card or PayPal, on the payment provider’s secure page, without the seller having access to card details; or by bank transfer, in which case the order is prepared once the funds are received.
7. Delivery
Delivery areas and costs are shown at the “Delivery” step. Pieces in stock ship within 24 to 48 working hours; made-to-order pieces are made in 2 to 3 weeks; for a quoted piece, the lead time is the one in the quotation. Failing any other date, delivery takes place no later than 30 days after the order.
In case of delay, the customer may ask the seller to deliver within a reasonable additional period; if delivery still does not take place, the customer may cancel the order and be refunded within 14 days.
The risk of loss or damage passes to the customer when the customer, or a third party the customer has named, takes physical possession of the piece. Receiving a parcel is covered on the Delivery and returns page.
8. Right of withdrawal
The customer has 14 days from receipt of the piece to withdraw, without giving a reason (article L. 221-18 of the French Consumer Code). The customer informs the seller by any unambiguous statement, for example by email or with the form below, then sends the piece back no later than 14 days after that. Return costs are borne by the customer.
The seller refunds all sums paid, including the original delivery costs at the standard rate, within 14 days of being informed of the withdrawal, using the payment method used for the order. The refund may be withheld until the piece is received or proof of its return is provided.
The customer is liable for any loss in value of the piece caused by handling beyond what is needed to establish its nature, characteristics and working.
The right of withdrawal does not apply to pieces made to the customer’s specifications or clearly personalised: colour on request, bespoke size or shape (article L. 221-28, 3°, of the French Consumer Code).

9. Legal guarantees
All pieces are covered by the legal guarantee of conformity and the guarantee against hidden defects. To use them, the customer writes to contact@henridejeant.com describing the defect, with a photo if possible.
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish that the lack of conformity exists, not when it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
Goods repaired under the legal guarantee of conformity benefit from a six-month extension of that guarantee.
The consumer may obtain a price reduction while keeping the goods, or end the contract and be refunded in full against return of the goods, if: 1° the seller refuses to repair or replace the goods; 2° the repair or replacement takes place after thirty days; 3° the repair or replacement causes the consumer major inconvenience; 4° the lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to end the contract straight away when the lack of conformity is serious enough to justify it, without first asking for repair or replacement. The consumer may not end the contract if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee until the repaired goods are delivered.
These rights result from articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs the legal guarantee of conformity in bad faith faces a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. It entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
10. Use
The seller is not liable for damage resulting from use contrary to the product page and the Care page, in particular a non-LED bulb or a higher wattage than stated, or installation outdoors or in a damp room.
11. Intellectual property
The forms, drawings, photographs and texts on the site belong to Henri Dejeant. No reproduction, even partial, is allowed without his written consent.
12. Personal data
Data provided with an order is used to process and deliver it. How it is handled, and your rights, are described in the legal notice.
13. Complaints and mediation
For any complaint, the customer first writes to contact@henridejeant.com. If no solution is found, the customer may refer the matter free of charge to the consumer mediator the seller belongs to: [to be completed: name, address and website of the consumer mediator].
14. Governing law
These terms are governed by French law. In the event of a dispute, the customer may bring proceedings before the court of the place where the customer lived at the time of the order or of the harmful event, or any other court with jurisdiction under ordinary law.
